These Terms of Service apply to your access to and use of the Lowrey Foods website and to purchases made through our online store.
This website is operated by Suki Bakery Ltd, trading as Lowrey Foods. In these Terms, “Lowrey Foods”, “we”, “us” and “our” refer to Suki Bakery Ltd. “You” and “your” refer to any visitor, customer or user of this website.
By accessing this website, creating an account or placing an order, you agree to these Terms of Service and to the policies referred to in them. Please read these Terms carefully before using the website or purchasing from us.
1. About our online store
Lowrey Foods sells New Zealand-made butter cookies, gift sets and related products through this website.
Our online store is hosted by Shopify, which provides the ecommerce platform through which our products are displayed and sold.
You may use this website only for lawful purposes and in accordance with these Terms.
2. Eligibility to place an order
By placing an order, you confirm that:
- you are legally capable of entering into a binding agreement;
- the information you provide is accurate, complete and current;
- you are authorised to use the payment method submitted with the order; and
- the products are being purchased for a lawful purpose.
If you place an order on behalf of a business or another person, you confirm that you have authority to bind that business or person to these Terms.
3. Product information
We take reasonable care to present product descriptions, ingredients, weights, images, prices and other information accurately.
Because our products are food products and may be made in different production batches, minor variations in colour, shape, placement, appearance and texture may occur.
Product photographs are illustrative. Screen settings, lighting and photography may affect how colours and product details appear.
Packaging, labels, availability and product specifications may be updated from time to time. The product information displayed at the time your order is placed will apply to that order, subject to any obvious error.
4. Allergens and dietary information
You are responsible for reviewing the ingredient, allergen and dietary information displayed on the relevant product page and product packaging before purchasing or consuming a product.
If you or the intended recipient has a food allergy, intolerance or specific dietary requirement, please contact us through our Contact Us page before placing the order.
Product and manufacturing information may change. The information printed on the product packaging should be checked before consumption.
5. Prices and currency
Product prices are displayed in the currency selected or presented by the website. Your payment provider may apply currency-conversion charges, international transaction fees or other charges that are outside our control.
Shipping charges, applicable taxes and other checkout charges will be shown before payment where they can be calculated by our store.
Prices and promotions may change without notice. A price change will not affect an order that has already been accepted and paid for, except where there has been an obvious pricing or system error.
6. Placing an order
Adding a product to your cart does not reserve it.
When you submit an order, you are making an offer to purchase the selected products under these Terms.
An automated order confirmation acknowledges that we have received your order. It does not prevent us from cancelling or correcting the order where:
- the product is unavailable;
- payment is declined or cannot be verified;
- the order contains an obvious pricing, description or system error;
- the shipping address is incomplete, invalid or unsupported;
- the order appears fraudulent, unauthorised or unlawful;
- the quantity ordered is not reasonably available; or
- we are unable to fulfil or lawfully deliver the order.
If we cancel an order after payment has been received, we will refund the amount paid for the cancelled products and any associated shipping charge that is no longer applicable.
7. Final orders and change-of-mind requests
Once an order has been confirmed and payment has been completed, it is treated as final.
We do not accept cancellations, returns, exchanges or refunds because:
- you have changed your mind;
- you ordered the wrong product, flavour or quantity;
- the recipient no longer wants the order;
- you found a different price elsewhere;
- your circumstances changed; or
- you no longer require the products.
This policy allows orders to move promptly into warehouse picking, packing and dispatch preparation.
Please check the products, quantities, recipient information, delivery address and destination country carefully before completing payment.
Nothing in this section limits any rights or remedies that cannot lawfully be excluded under applicable consumer law.
8. Order changes and delivery information
We cannot guarantee that an order, delivery address, recipient name, telephone number, product selection or delivery instruction can be changed after payment.
You must provide a complete and accurate delivery address, including any apartment, unit, building, postcode, state, province or regional information required by the destination.
You must also provide an active recipient telephone number and email address where required for courier delivery or customs clearance.
If you notice an error, contact us immediately through our Contact Us page. We will try to help, but changes are not guaranteed once processing has begun.
9. Shipping and delivery
Shipping services, processing estimates, delivery information, restricted destinations and damage-claim requirements are explained in our Shipping Policy.
Delivery dates and transit times are estimates unless we expressly agree otherwise in writing. Delays may occur because of customs processing, courier disruptions, weather, public holidays, incomplete addresses, recipient availability or circumstances outside our reasonable control.
You and the recipient are responsible for monitoring tracking information and responding promptly to courier or customs requests.
10. Customs duties and import requirements
International orders may be subject to customs duties, import taxes, GST, VAT, brokerage charges, handling fees, clearance fees or other charges imposed by the destination country, courier or customs authority.
Unless expressly included at checkout, these charges are not included in the product price or shipping charge and are the responsibility of the customer or recipient.
The customer and recipient are responsible for:
- checking whether the products may be imported into the destination;
- providing information required for customs clearance;
- paying applicable import charges;
- responding to the courier or customs authority promptly; and
- complying with destination-country import requirements.
We cannot guarantee the amount of any import charge or the outcome or timing of customs clearance.
11. Refused, unclaimed or undeliverable orders
If an order is refused, remains unclaimed, cannot clear customs, or cannot be delivered because of incorrect information, recipient inaction or unpaid import charges, it may be returned, abandoned or destroyed in accordance with courier or customs procedures.
Where a parcel is returned to us and a refund is legally or contractually appropriate, reasonable costs already incurred may be deducted where permitted by law. These may include outbound shipping, return shipping, customs charges, handling costs and losses relating to food products that cannot be resold.
A returned order will not automatically be resent. Any reshipment must be agreed with us and may require payment of additional shipping and related costs.
12. Delicate products and minor breakage
Lowrey Butter Cookies are intentionally delicate, fine and melt-in-the-mouth. Their fragile structure means that some loose crumbs or minor breakage may occur during transport.
Minor breakage that does not materially affect the overall usability or quality of the product will not normally qualify for a refund or replacement.
Where there is significant damage, missing product, an incorrect item or a genuine product-quality concern, contact us promptly and follow the evidence requirements in our Shipping Policy.
Courier damage claims may require photographs of the complete outer carton, shipping label, inner packaging, affected tins and opened contents. Please retain all packaging and products until the claim has been reviewed.
13. Faulty, incorrect or materially misdescribed products
If you believe a product is faulty, contaminated, incorrect, materially damaged or materially different from its description, contact us through our Contact Us page as soon as reasonably possible.
Include:
- your order number;
- a clear description of the issue;
- photographs of the product and packaging;
- the product flavour and quantity affected;
- the best-before or batch information, where visible; and
- any other information reasonably required to assess the matter.
We may ask you to retain the product and packaging while we investigate.
Any remedy will depend on the circumstances, available evidence and your rights under applicable law.
14. Consumer rights
These Terms are not intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
Customers in New Zealand may have rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.
Where those laws apply and conflict with these Terms, the applicable legal rights will prevail.
15. Promotions and discount codes
Promotions and discount codes may be subject to additional conditions, including:
- minimum purchase requirements;
- eligible products or destinations;
- customer or order limits;
- expiry dates;
- exclusions; and
- restrictions on combining promotions.
Unless stated otherwise, only one discount code may be used per order.
Discount codes must be entered before payment is completed. We are not required to apply a discount retrospectively after an order has been placed.
We may cancel or refuse a promotion where there has been misuse, an obvious error, unauthorised distribution or fraudulent activity.
16. Accounts and customer information
If you create an account, you are responsible for keeping your login credentials secure and for activity carried out through your account.
You must provide accurate, complete and current information and update it when necessary.
Please notify us promptly if you believe your account or payment information has been used without authorisation.
17. Website use and prohibited conduct
You must not:
- use the website for an unlawful or fraudulent purpose;
- submit false, misleading or impersonated information;
- introduce malware, viruses or harmful code;
- interfere with the website, checkout or security systems;
- attempt to gain unauthorised access to accounts or systems;
- scrape, harvest or collect personal or contact information;
- send spam, phishing messages or unsolicited commercial communications;
- copy or exploit website content without permission; or

You may view the website and make purchases for personal or legitimate business use. You may not reproduce, republish, distribute, modify, sell or commercially exploit our content without prior written permission.
19. Customer submissions
If you submit a review, photograph, comment, message or other content, you confirm that:
- you have the right to submit it;
- it is accurate and not misleading;
- it does not infringe another person’s rights;
- it is not unlawful, abusive, defamatory or malicious; and
- it does not contain harmful code or spam.
We may moderate, remove or decline to publish submitted content where reasonably necessary.

Third-party services may be governed by their own terms and privacy policies. We are not responsible for the content, availability or practices of an independent third-party website or service, except to the extent required by law.

By providing personal information through the website, checkout or contact form, you confirm that the information is accurate and that you are authorised to provide it.
22. Website availability and errors
We aim to keep the website accurate, secure and available, but we do not guarantee that access will always be uninterrupted or error-free.
We may correct errors, update content, suspend features or carry out maintenance without prior notice.
If an obvious error affects an order, price, product description, promotion or availability, we may contact you to correct or cancel the affected part of the transaction. Where an order is cancelled, applicable payments will be refunded.
23. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential loss arising from use of the website or purchase of our products.
We are not responsible for loss caused by:
- incorrect or incomplete information supplied by the customer;
- failure by the recipient to respond to a courier or customs authority;
- import restrictions or charges imposed by another country;
- events outside our reasonable control;
- misuse, improper storage or alteration of a product after delivery; or
- use of the website contrary to these Terms.
Nothing in this section excludes or limits liability where doing so would be unlawful.
24. Events outside our reasonable control
We are not responsible for delay or failure caused by events outside our reasonable control, including severe weather, natural disasters, transport disruption, industrial action, border closures, customs delays, government action, public-health emergencies, power failures, internet outages or courier-network disruption.
We will take reasonable steps to manage the effect of such events where practical.
25. Changes to these Terms
We may update these Terms from time to time to reflect changes to our products, services, website, business practices or legal obligations.
The updated Terms will be published on this page with a revised “Last updated” date.
The Terms in effect when an order is placed will generally apply to that order, unless a change is required by law.
26. Severability
If any part of these Terms is found to be invalid, unlawful or unenforceable, that part will be interpreted or removed only to the extent necessary. The remaining provisions will continue to apply.
27. No waiver
If we do not immediately enforce a provision of these Terms, this does not mean that we waive our right to enforce it later.
28. Governing law
These Terms are governed by the laws of New Zealand.
Subject to any mandatory consumer rights or jurisdictional requirements, disputes relating to these Terms, the website or an order will be subject to the jurisdiction of the New Zealand courts.
